Introductory Provisions and Definitions

These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the legal relationship between ScrooserPrague s.r.o., with its registered office at náměstí 14. října 1307/2, Smíchov, 150 00 Prague 5, Company ID: 05523711, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. C 265110 (hereinafter referred to as “ScrooserPrague” or the “Company”), and a natural person who, as a consumer, enters into a rental contract for an electric scooter with ScrooserPrague (hereinafter referred to as the “Customer”).

Definitions:

  • Administrative Fee: A fee charged by ScrooserPrague for administrative actions related to the handling of fines, damages, or other violations by the Customer, up to a maximum of CZK 750.
  • Price List: The current list of prices for the rental of Electric Scooters published on the ScrooserPrague website (www.scroosertour.com) or at the physical rental office.
  • Electric Scooter: An electric vehicle provided by ScrooserPrague for rental (in particular, SCROOSER scooters, Hugo Bikes, or E-CAFÉ e-bikes depending on the current offer of ScrooserPrague).
  • Office: The ScrooserPrague offices located at Saská 289/6, 118 00, Prague 1.
  • Rental Period: The period for which the Electric Scooter is rented to the Customer, as stated in the Price List or confirmed by ScrooserPrague upon payment.
  • Permitted Area: The geographical area designated by the Guide within which the Customer may use the Electric Scooter.
  • Guide: An employee or contractual partner of ScrooserPrague who accompanies the Customer during the entire rental period and provides instructions on how to use the Electric Scooter.
  • Service: A tour conducted by ScrooserPrague, including the rental of an Electric Scooter together with a Guide based on the Customer’s order and according to these GTC and the concluded Agreement.
  • Agreement: A rental agreement concluded between ScrooserPrague and the Customer by payment of the fee for the Electric Scooter rental, on the basis of which the Customer is provided with the Electric Scooter for temporary use for a fee, exclusively together with the accompaniment of a Guide.
  • Consumer: A natural person acting outside the scope of their business activities or profession, as defined in Section 419 of Act No. 89/2012 Coll., the Civil Code.
  • Website: The ScrooserPrague website at www.scroosertour.com.

ScrooserPrague reserves the right to amend these GTC at any time. Changes take effect on the date of their publication on the ScrooserPrague website – www.scroosertour.com.

The Customer acknowledges that ScrooserPrague is not obliged to conclude the Agreement and may refuse to provide the Service, especially if the Customer does not meet the conditions of these GTC or if there is a justified concern of breach of the Agreement or these GTC.


ORDER and Conclusion of the Agreement

The Customer places an order for the Service through third-party booking systems (e.g., Airbnb, TripAdvisor, or Viator), via a form on the Website, by phone at the number listed on the Website, or in person at the Office.

The Customer pays the fee (see Article 5) for the Service either through third-party booking forms, a form (payment gateway) on the Website, or, in the case of telephone or personal orders, directly on-site at the Office. The Customer is obliged to pay at least 50% of the fee before the order is confirmed by ScrooserPrague. ScrooserPrague will issue the Customer a receipt for the payment of the Service fee and send it to the Customer according to the payment method used.

The Agreement is concluded upon confirmation of the Service order by ScrooserPrague and payment of the Service fee by the Customer in accordance with the valid Price List. By paying the fee, the Customer confirms that they have read and agree to these GTC.

Before taking over the Electric Scooter, the Customer must present a valid identification document (e.g., ID card, passport) to ScrooserPrague and prove that they are over 15 years of age, unless otherwise specified by ScrooserPrague. ScrooserPrague is entitled to make a copy of the Customer’s ID card or passport before the Service starts. ScrooserPrague reserves the right to refuse to provide the Service if the Customer does not present an ID card or passport.


Rights and Obligations of the Customer

The Customer is obliged to visually inspect the Electric Scooter before taking it over and report any visible defects or damages to ScrooserPrague or the Guide.

By accepting the Electric Scooter without reporting any defects, the Customer confirms that the Electric Scooter is in proper technical condition.

The Customer agrees to use the Electric Scooter exclusively with the accompaniment of the Guide and in accordance with the Guide’s instructions, these GTC, the Agreement, local legal regulations, and traffic rules, in particular Act No. 361/2000 Coll., on Road Traffic.

The Customer must not:

  • Hand over the Electric Scooter to a third party without prior consent from ScrooserPrague.
  • Use the Electric Scooter without the Guide or outside the Permitted Area.
  • Use the Electric Scooter for racing, stunts, or other dangerous activities.
  • Overload the Electric Scooter beyond the allowed weight limit (available upon request).
  • Handle the Electric Scooter in a way that could cause damage (e.g., disassembly, unauthorized modifications).
  • Use the Electric Scooter under the influence of alcohol, drugs, or medications that impair the ability to operate it.

The Customer is obliged to wear the helmet provided by ScrooserPrague at all times during the use of the Electric Scooter if required by law or the Guide’s instructions.

The Customer is obliged to:

  • Remain with the Guide for the entire Rental Period and follow their instructions.
  • Use the Electric Scooter safely and with due care.
  • Immediately report any accident, damage, loss, or theft to ScrooserPrague or the Guide.
  • Return the Electric Scooter in the same condition (except normal wear).

The Customer bears full responsibility for any damage, fines, penalties, or other charges related to the use of the Electric Scooter.

The use of the Electric Scooter is at the Customer’s own risk.

ScrooserPrague is not liable for injury or damage unless caused by a defect that could not be detected by proper inspection.

The Customer must ensure their health allows safe use of the Electric Scooter.

Upon return, ScrooserPrague will inspect the Scooter and may charge compensation for damages. A handover protocol will be signed. Payment is due immediately unless agreed otherwise.


Rights and Obligations of ScrooserPrague

ScrooserPrague undertakes to:

  • Provide the Electric Scooter in good condition.
  • Ensure Guide accompaniment.
  • Inform about rules of use (oral instruction is sufficient).

ScrooserPrague reserves the right to:

  • Terminate the Agreement and take back the Scooter in case of breach.
  • Charge fees for damages, fines, or admin work.
  • Retain fees in case of Customer breach.
  • Suspend services due to adverse conditions without compensation.

Fees and Penalties

The Customer must pay according to the valid Price List before the rental, in cash or by card.

In case of a breach:

  • Damage Compensation: Repair/replacement beyond wear.
  • Administrative Fee: Up to CZK 750 per incident.

The Customer is also liable for any fines or penalties incurred due to their use.

Payment is due on-site or within 5 days by bank transfer or cash.


Liability

The Customer is fully liable for damage to the Scooter, third-party property, or persons, unless caused by an undetectable defect.

ScrooserPrague is not liable for injuries or damages unless caused by a defect not detectable by the Customer.

ScrooserPrague is not liable for delays or non-performance due to force majeure (e.g., natural disasters, weather, strikes, technical issues).


Cancellation of Reservation

The Customer may cancel via email at info@scroosertour.com.

  • 72+ hours before the tour = 100% refund (minus 3rd-party fees)
  • Less than 72 hours = non-refundable

No cancellation rights for Services already partially or fully used.


Complaints Procedure

Complaints must be submitted in writing or via email within 30 days of the Service. The complaint must include a description and a request.

ScrooserPrague will respond within 30 days. If justified, they will offer compensation (refund or replacement).


Personal Data Protection

ScrooserPrague processes personal data in accordance with GDPR and Czech law. Details are in the Privacy Policy available on the Website.


Communication and Dispute Resolution

All communication takes place via email, phone, or in person at the Office.

Complaints are handled within 30 days.

In case of disputes, the Customer may contact the Czech Trade Inspection Authority (adr.coi.cz) or the EU platform at http://ec.europa.eu/consumers/odr.


Final Provisions

These GTC and the Agreement are governed by Czech law.

Disputes will be resolved by a competent court based on ScrooserPrague’s registered office unless otherwise agreed.

If any provision is found invalid, the rest remains in effect. Invalid provisions will be replaced by ones that reflect the original intent as closely as possible.

These GTC take effect on June 1, 2025, and apply to all Agreements concluded after that date.
